At our option, we may supply surplus materials as a precaution versus damage or loss. On completion of the contract any surplus materials will remain the home of Flex Fitness Devices and will be immediately gotten rid of from site. 12 (Group Training in Warwick ). The arrangement of labour and an appropriate forklift for the unloading of our products and handling on to the erection site and/or covered storage location is the duty of the purchaser, unless otherwise concurred in writing.
13. Where our products are stored on site for any factor whatever in between the time of delivery and the start of setup, the care and protection of such materials is the sole responsibility of the buyer (Group Training in Aveley Western Australia). Where the storage is at a location remote from the setup website, transfer of our materials to site is the obligation of the purchaser.
14. If the Buyer requires special packing in relation to the Goods it should be agreed to in writing in between the Purchaser and the Seller, and the expense of the very same is to the Buyer's account and accordingly will be included in the Purchase Price. If the Seller stops working to include the expense of special packing in the Purchase Rate the Buyer should pay to the Seller such expenses as needed.
Where installation is included in the contract the arrangement of a clear working site and adequate access will be the duty of the buyer. It is our normal practice to inform delivery beforehand in order to help with the clearance of our workspace. We reserve the right to make an evaluation of the working area, and to postpone proceeding to website at no penalty to the Seller if insufficient gain access to or facilities exist 16.
In the case of structures which need website welding a 3 stage supply with sole gain access to and adequately maintained voltage is also the obligation of the buyer. We will be pleased to talk about any difficulties in the arrangement of these requirements and make alternative arrangements if required, however unless otherwise concurred in writing, any extra expenses will be to the buyer's account.
It is regular treatment to bolt racking structures to the flooring, and unless otherwise, our quotation makes allowance for this. Nevertheless, if the flooring piece is strengthened with grid steel mesh or comparable products to a level less than 70 mm below the surface area, unique drilling equipment will be required and any additional expenses incurred will be to the buyer's account.
Unless stated in writing our quotation presumes an affordable condition of flatness of flooring. Flatness tolerances must be within + 3 mm inside a 3 metre radius. Additional costs incurred in making up for a malfunctioning or unequal floor will be to the buyer's account. 19. We reserve the right to appoint or subcontract out the entire or any part of this contract at our discretion.
Whenevers estimated for our completion or delivery work from the date of receipt by us of a composed order to continue, together with all info and particulars we need to proceed with the manufacture without disruption or delay. 21. The Purchaser shall pay the Seller immediately. If the Purchaser stops working to make a payment by the due date, the Seller may, without notification, withhold shipment of any further Goods to the Buyer and may terminate, without liability to the Purchaser, any or all subsisting contracts in between the Seller and the Purchaser.
If payment is not made on the due date, the Seller might charge interest on the quantity payable at the rate of 5% over the 90 day bank expense rate relevant on the day the payment is due. 23. The Purchase Cost is not inclusive of items and services tax, unless otherwise defined in writing.
